THE PREAMBLE (प्रस्तावना)

• प्रस्तावना का प्रारूप जवाहरलाल नेहरू द्वारा तैयार किया गया था, जो अमेरिकी मॉडल पर आधारित था, जिसका उद्देश्य संकल्प में वर्णित था, जिसे 22 जनवरी, 1947 को घटक विधानसभा द्वारा अपनाया गया था।(The format of the preamble was prepared by Jawaharlal Nehru, based on the American model, described in the resolution, adopted by the constituent assembly on January 22, 1947.)
• प्रस्तावना को 42 वें संशोधन अधिनियम 1976 द्वारा ‘संप्रभु लोकतांत्रिक गणराज्य’ से ‘संप्रभु समाजवादी, धर्मनिरपेक्ष लोकतांत्रिक गणराज्य’ और राष्ट्र की एकता और अखंडता के लिए बदल दिया गया है।(The Preamble has been changed by the 42nd Amendment Act 1976 from ‘Sovereign Democratic Republic‘ to ‘Sovereign Socialist, Secular Democratic Republic‘ and the unity and integrity of the nation.)
• [ यह पहली और आखिरी बार था जब प्रस्तावना को बदला गया या संशोधित किया गया। ][This was the first and last time the preface was changed or revised. ]
• गोलखनाथ मामले (1976) में, सर्वोच्च न्यायालय ने माना था कि प्रस्तावना को संविधान के एक भाग के रूप में मान्यता नहीं दी जा सकती है।(In the Golkhanath case (1976), the Supreme Court held that the preamble cannot be
  recognized as a part of the Constitution.)
• केसवनंद भारती बनाम केरल राज्य (1973) में सर्वोच्च न्यायालय ने माना है कि प्रस्तावना संविधान का एक हिस्सा है।(In Kesavananda Bharati v. State of Kerala (1973), the Supreme Court has held that the preamble is a part of the Constitution.)
• सर्वोच्च न्यायालय ने कहा कि प्रस्तावना में ‘मूल तत्व’ को अनुच्छेद 368 के तहत संशोधित नहीं किया जा सकता है।(The Supreme Court held that the ‘core elements’ in the preamble cannot be amended under Article 368.)
• अदालत का विचार था कि ‘हमारे संविधान की रूपरेखा प्रस्तावना में उल्लिखित मूल तत्वों पर आधारित है।(The court was of the view that ‘the framework of our constitution is based on the core elements mentioned in the Preamble.)
• यदि इनमें से कोई भी तत्व हटा दिया जाता है,ढांचा नहीं बचेगा और यह समान संविधान नहीं होगा या यह अपनी पहचान नहीं बनाए रख सकता है ‘।(If any of these elements are removed, the structure will not survive and it will not have the same constitution or it cannot maintain its identity ‘.)
